This General Privacy Policy (“Privacy Policy”) is being provided on behalf of the family of auto dealerships and related entities using the “Galpin” name, which includes, but is not limited to Galpin Motors, Inc., Galpin Volkswagen LLC, Galpin Jaguar Lincoln-Mercury, Inc., and Boeckmann Automotive, LLC (dba Galpin Honda), hereinafter collectively referred to as “Galpin”, “we,” “us” or “our”. This Privacy Policy applies to both the online and offline collection of personal information by Galpin. By using our website and services you acknowledge you have read and understand the terms and conditions of this Privacy Policy. If you do not agree to the terms and conditions of this Privacy Policy, please immediately discontinue using our website or services.

PLEASE NOTE THE ARBITRATION PROVISION SET FORTH BELOW, WHICH MAY, EXCEPT WHERE AND TO THE EXTENT PROHIBITED BY LAW, REQUIRE YOU TO ARBITRATE ANY CLAIMS YOU MAY HAVE AGAINST GALPIN ON AN INDIVIDUAL BASIS. This Privacy Policy describes our overall privacy practices for the website. Please note that in the event we amend the Privacy Policy, posting the amended version will serve as notice to you of that change and the policy will note its effective date.

Non-identifying Information Collection

Some information collected is non-identifying. For example, although our website servers collect information about a user’s internet protocol address, our server is not able to automatically associate that information with a particular user. How We Respond to Do Not Track Signals

Some browsers have a “do not track” feature that lets you tell websites that you do not want to have your online activities tracked. These features are not yet uniform, so we are not currently set up to respond to those signals.

We collect certain personally identifying information that users voluntarily provide to us. For example, we collect the email addresses of those who contact us by email. We also collect information that you voluntarily provide to us in surveys. As described above, we use that information to serve you, to improve the content of our website, and to contact you for marketing purposes. We work with analytics companies to help us understand how our websites are being used, by how many users, for how long, and how frequently. Using analytics, we receive counts of the screens and features of our website that are used, the countries from which they are used, device language settings, demographics and interests information, including the types of devices, operating systems, browsers, carriers, IP addresses and wireless connections our users are using.

We may use third-party advertising companies to measure the effectiveness of ads on our website. Any such information is anonymous. They may use this anonymous information about your visits to this and other sites in order to provide advertisements about goods and services of potential interest to you. The information is anonymous and does not link online actions to an identifiable person. At this time, we have contracted with companies like Dataium, DoubleClick, and Google Analytics to collect information about how users navigate our website. The anonymous profiles are used to provide users content specifically tailored to them. We maintain presence on several social networking and blogging platforms, such as Facebook and Twitter, and we also incorporate some third party social networking features onto our website. These third party social networking platforms and blogging platforms have their own privacy policies which explain how the third parties that provide them will use and protect your information. In accordance with those policies (and your privacy settings within your social networking accounts) information about your activities on our website (such as “John Doe likes this car” or “Jane Doe viewed this customer review”) may be published to your social network.

Security

We implement reasonable security measures to ensure the security of your personal information. Please understand, however, that no data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to us is done at your own risk. By continuing to use or access our website or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Services. We may post a notice via our website if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Collection and Use of Information from Children

Our website and services are not intended for children. We do not knowingly collect personal information from children, and none of our services are designed to attract children. Dispute Resolution and Agreement to Arbitrate

Except where and to the extent prohibited by law, by continuing to use and access our website, you and Galpin agree that, if there is any controversy, claim, action, or dispute arising out of or related to your use of the Services or the breach, enforcement, interpretation, or validity of this Policy or any part of it (“Dispute”), both parties shall first try in good faith to settle such Dispute by providing written notice to the other party describing the facts and circumstances of the Dispute and allowing the receiving party thirty (30) days in which to respond to or settle the Dispute. Both you and Galpin agree that this dispute resolution procedure is a condition precedent that must be satisfied before initiating any litigation or filing any claim against the other party. IF ANY DISPUTE CANNOT BE RESOLVED BY THE ABOVE DISPUTE RESOLUTION PROCEDURE, YOU AGREE THAT THE SOLE AND EXCLUSIVE JURISDICTION FOR SUCH DISPUTE WILL BE DECIDED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. ARBITRATION ON AN INDIVIDUAL BASIS MEANS THAT YOU WILL NOT HAVE, AND YOU WAIVE THE RIGHT FOR A JUDGE OR JURY TO DECIDE YOUR CLAIMS, AND THAT YOU MAY NOT PROCEED IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE CAPACITY. Other rights that you and we would otherwise have in court will not be available, or will be more limited in arbitration, including discovery and appeal rights. All such disputes shall be exclusively submitted before an arbitrator to be mutually agreed upon by both parties. The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute arising under or relating to the interpretation, applicability, enforceability, or formation of this Privacy Policy, including any claim that all or any part of this Privacy Policy is void or voidable.

Choice of Law

This Privacy Policy has been made in and shall be construed in accordance with the laws of the State of California, without giving effect to any conflict of law principles. Any disputes or claims not subject to the arbitration provision discussed above shall be resolved by a court located in the State of California and you agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.
